A 3x leveraged Bitcoin ETF filing is a proposal, not an approval

The SEC's own notice records what Cboe BZX filed. It does not record whether, or when, the SEC will approve it.
Risk boundary: A regulatory filing is not an approval, a listing date, or investment advice. The SEC's review is ongoing.
What happened
The SEC's own filing record states this is a "Notice of Filing of a Proposed Rule Change to List and Trade Shares of 3x Gold ETF, 3x Silver ETF, 3x Bitcoin ETF, 3x Ether ETF, 3x Crude Oil ETF, and 3x Natural Gas ETF, each a Series of the VS Trust, under BZX Rule 14.11(e)(4)." The filing is designated SR-CboeBZX-2026-065, with an SEC issue date of Aug. 14, 2026.
The Block reported that "the SEC published a notice that Cboe BZX Exchange has filed a proposed rule change to list and trade 3x-leveraged bitcoin and ETH ETFs." The Block also reported that "the funds aim to deliver three times the daily performance of their respective commodities by holding futures contracts," structured as "commodity pools" under CFTC oversight rather than as traditional 1940 Act investment companies.
Why it matters
A notice of filing is the SEC's own record that a proposal exists and is open for public comment; it is not a decision. The SEC's page lists public comments as due "21 days after date of publication in the Federal Register," which is a review step, not an outcome.
Cyrvola treats the SEC's own filing notice as the primary evidence of what was proposed, and treats The Block's reporting as added structural detail (the futures-based, commodity-pool design) rather than as a second vote on whether the proposal will be approved.
What the market is watching
The open question is whether, and on what timeline, the SEC approves, modifies, or rejects the proposed rule change. Neither source in this dispatch states an approval date, and none should be inferred from the filing alone.
This dispatch includes no market-price observation and no social signal. A 3x leveraged product proposal is not itself evidence of investor demand, fund performance, or a trading opportunity.
